The notion of reasonable interpretation of legal texts, as opposed to the absurd or unacceptable interpretation, is presupposed in different legal theories as the fundamental basis of legal rationality and as a clear limitation to chaotic behaviour by courts. This article argues that the ever-present notion of reasonability is not a useful descriptive tool for understanding legal practices or how legal institutions work. The article builds on radical legal realism perspective in order to develop two arguments supporting this claim. First, (...) it argues that, from an empirical point of view, the complexity of contemporary law and its multiple layers of normativity do not allow for the description of what a reasonable interpretation is, since no coherent universal interpretative community can be envisioned. Second, from a conceptual point of view, it argues that describing the references interpreters make to reasonability as references to a semantic object—that is, to some kind of universal “reasonableness”, a model of reasonable behaviour or rationality—is not a reliable way of understanding judicial practice in a certain legal context. This is the case because, as an internal justification discourse, the appeal to reasonability by the interpreter has no bearing on truth or correctness. Nothing prevents courts from cherry-picking a meaning for reasonability in each case, using it as the justification to solve similar cases in different, sometimes contradictory ways. In short, the concept of reasonability cannot be taken, in itself, as an instrument of legal analysis. As a prescriptive discourse, it can merely be one of the objects legal science intends to observe and explain. Its discursive functions—not its semantic references—, as part of a strategy to convince and to justify, are the only observable elements that can sustain a coherent falsifiable description by legal science. BackgroundPreprint usage is growing rapidly in the life sciences; however, questions remain on the relative quality of preprints when compared to published articles. An objective dimension of quality that is readily measurable is completeness of reporting, as transparency can improve the reader’s ability to independently interpret data and reproduce findings.MethodsIn this observational study, we initially compared independent samples of articles published in bioRxiv and in PubMed-indexed journals in 2016 using a quality of reporting questionnaire. After that, we performed paired comparisons (...) between preprints from bioRxiv to their own peer-reviewed versions in journals.ResultsPeer-reviewed articles had, on average, higher quality of reporting than preprints, although the difference was small, with absolute differences of 5.0% [95% CI 1.4, 8.6] and 4.7% [95% CI 2.4, 7.0] of reported items in the independent samples and paired sample comparison, respectively. There were larger differences favoring peer-reviewed articles in subjective ratings of how clearly titles and abstracts presented the main findings and how easy it was to locate relevant reporting information. Changes in reporting from preprints to peer-reviewed versions did not correlate with the impact factor of the publication venue or with the time lag from bioRxiv to journal publication.ConclusionsOur results suggest that, on average, publication in a peer-reviewed journal is associated with improvement in quality of reporting. They also show that quality of reporting in preprints in the life sciences is within a similar range as that of peer-reviewed articles, albeit slightly lower on average, supporting the idea that preprints should be considered valid scientific contributions. IntroductionTranscranial magnetic stimulation is a consolidated procedure for the treatment of depression, with several meta-analyses demonstrating its efficacy. Theta-burst stimulation is a modification of TMS with similar efficacy and shorter session duration. The geriatric population has many comorbidities and a high prevalence of depression, but few clinical trials are conducted specifically for this age group. TBS could be an option in this population, offering the advantages of few side effects and no pharmacological interactions. In this study, we explore a 100 years of Work and Organizational Psychology. To do this, we carry out a bibliometric performance and network analysis to understand the evolution structure and the most important themes in the field of study. To perform the BNPA, 8,966 documents published since 1919 were exported from the Web of Science and Scopus databases. The SciMAT software was used to process data and to create the evolution structure, the strategic diagram, and the thematic network structure (...) of the strategic themes of the field of WOP. We identified 29 strategic clusters and discuss the most important themes and their relationship with other clusters. This research presents the complete evolution of the field of study, identifying emerging themes and others with a high degree of development. What is the function of moral principles within the body of moral knowledge? And what must be the nature of moral principles in order for them to carry out this function? A specific set of answers to these questions is widely accepted among moral philosophers – so widely accepted as almost to constitute a sort of orthodoxy. The answers embody a view of the place of principles within the body of morality which crosses the lines between cognitivism and non-cognitivism. Though (...) I have put the question in cognitivist terms and shall discuss it in those terms, I think a similar question and a more or less parallel discussion could be given in non-cognitivist terms. Perhaps the time-honoured debate between the two positions can be suspended, at least temporarily, while we examine, not the nature of morality, but its structure. (shrink)

This is the fourth volume of the Clarendon edition of Robert Burton's Anatomy of Melancholy and the first of three volumes of Commentary. It contains commentary on the text up to p. 327 of volume one - i.e. The Argument of the Frontispeice, Democritus to the Reader, and Partition 1 as far as the end of Section 2, Member 3, Subsection 15: 'Misery of Schollers'. In his study of morbid psychology as it was understood in his day, Burton cites many (...) other writers. No previous edition of the Anatomy has identified all of these or verified all his quotations. In addition to explanatory notes and translations of all the passages in Latin, this edition attempts to locate all Burton's sources in the actual books he himself owned or to which he probably had access. The last of the three volumes of commentary will contain a Biobibliography listing over 1,500 authorities referred to by Burton, many very obscure, and will give not only bibliographical details but information about the writers. The first volumes of the great University of Toronto Press edition of the works of John Stuart Mill, edited by John M. Robson, appeared in 1963, and the edition was completed in 1991. Not surprisingly, it has generated a great deal of discussion of Mill's thought. The bibliography in John Skorupski's Companion to Mill lists some 350 items pertinent to Mill published since 1963, although it makes no attempt at comprehensive coverage of English-language studies and has nothing in any foreign (...) language. No one can keep up with all of this secondary material. It is not the least of the virtues of the Companion that it gives us a broad survey of much of the recent research and thought about Mill. I suspect that some of the articles will not be very helpful to bewildered undergraduates hoping for a boost on an assignment. But all of them will be useful to advanced students and scholars who want to know where we are on Mill these days. (shrink)

This Festschrift in Professor Kristeller’s honor consists of contributions by scholars who have had some connection with Columbia University, his "intellectual home in the United States for three decades." It also includes a Tabula Gratulatoria listing many other friends from the United States and Europe. The editor’s opening essay provides an interesting and informative account of this scholar’s academic career, and should be read together with the complete annotated bibliography of his publications through 1974. The latter lists 149 "major publications" (...) and 220 "minor publications." Kristeller’s contributions to the history of Renaissance philosophy are well known to historians of philosophy, and deservedly so. Here reference should be made to his groundbreaking studies on Marsilio Ficino and Pomponazzi, and on others such as Pico della Mirandola and Petrarch, as well as on Renaissance Platonism, Aristotelianism in the Renaissance, Thomism in the Renaissance, Paduan Averroism, and Alexandrism. But he has also contributed greatly to the fields of medieval and Renaissance history, and especially to our understanding of Renaissance humanism, Renaissance music, and Renaissance art. He is universally recognized as one of the world’s foremost authorities on manuscript research, as is witnessed, for example, by the cooperative project, Catalogus Translationum et Commentariorum, which he founded, and by his Iter ltalicum. In all of these enterprises he has set an enviable example for other scholars by the exacting standards and the breadth of his expertise. It is only fitting, then, that the many essays in this Festschrift should reflect the breadth and depth of the scholarship so evident in the man to whom they are dedicated. It is generally believed that the uncertainty relation Δq Δp≥1/2ħ, where Δq and Δp are standard deviations, is the precise mathematical expression of the uncertainty principle for position and momentum in quantum mechanics. We show that actually it is not possible to derive from this relation two central claims of the uncertainty principle, namely, the impossibility of an arbitrarily sharp specification of both position and momentum (as in the single-slit diffraction experiment), and the impossibility of the determination of the path (...) of a particle in an interference experiment (such as the double-slit experiment). J. B. Schneewind's "The Invention of Autonomy" has been hailed as a major interpretation of modern moral thought. Schneewind's narrative, however, elides several serious interpretive issues, particularly in the transition from late medieval to early modern thought. This results in potentially distorted accounts of Thomas Aquinas, Hugo Grotius, and G. W. Leibniz. Since these thinkers play a crucial role in Schneewind's argument, uncertainty over their work calls into question at least some of Schneewind's larger agenda for the history of ethics.

In the paper I offer a brief sketch of one of the sources of utilitarianism. Our biological ancestry is a matter of fact that is not altered by the way we describe ourselves. With philosophical theories it is otherwise. Utilitarianism can be described in ways that make it look as if it is as old as moral philosophy – as J. S. Mill thought it was. For my historical purposes, it is more useful to have an account that brings out (...) what is specific about Benthamism and its descendants. Let us try to make do with the following. First, utilitarianism asserts that the fundamental requirement of morality is that we are to maximize good, for everyone and not just for the agent. This basic principle presupposes that it makes sense to think of aggregating goods to make a total, and of comparing amounts of good thus aggregated. Second, the good to be brought about is located in feelings of pleasure, and the evil to be avoided in feelings of pain. These feelings have inherent value or disvalue regardless of how they are caused to exist and regardless of their own consequences. Third, all moral principles can be derived from the requirement that good be maximized. The principles involved in evaluating agents as well as in giving moral direction to action are nothing but applications of the basic principle. (shrink)

This study investigates specific behavioral perceptual differences of ethics between practitioners and students enrolled in sales classes. Respondents were asked to indicate their beliefs to issues related to ethics in sales. A highly significant difference was found between mean responses of students and sales personnel. Managers indicated a greater concern for ethical behavior and less attention to sales than did the students. Students indicated a strong desire for success regardless of ethical constraints violated.

We present six significant open problems in Pure Inductive Logic, together with their background and current status, with the intention of raising awareness and leading ultimately to their resolution.
